Conditions of Rental Agreement for ALL Hire Equipment

 

  1. HIRE OF ITEMS/EQUIPMENT
    1.1Jazz Party Hire agrees to rent equipment to the hirer on the date indicated in the rental agreement on the terms set out in this agreement. 
    1.2 Equipment refers to items hired out. 
    1.3 Hirers must be over 18 years of age.

     

  2. PAYMENT OF HIRING FEE AND SECURITY DEPOSIT
    2.1 A deposit of $50.00 is required to secure your booking, full payment required 5 days prior to hire. 
    2.2 Deposits are non-refundable. If cancellation is more than 7 days prior to booking all money (excluding deposit) will be refunded. If cancelled within 7 days of booking (including the 7th day) then NO refudn will be given.  NO refunds for bookings made in December, January and any school holidays.  
    2.3 Bookings made in December and January require a 50% NON-REFUNDABLE deposit.
    2.4 A late collection fee of $50.00 will be payable by the hirer if any of the equipment is not available for collection on the set collection day and time arranged. (i.e. house is locked or unattended).
     

  3. DAMAGE TO/LOSS OF EQUIPMENT ON HIRE FROM JAZZ PARTY HIRE
    3.1 The hirer is responsible for the safe keeping of all equipment from the delivery time to pick-up time.  Any damaged/lost/stolen equipment will be paid for by the hirer immediately on demand by Jazz Party Hire as stated in Clause 5.4.
    3.2 The hirer agrees to pay Jazz Party Hire the replacement value for any equipment if lost, stolen or damaged between the times of delivery and collection.
    3.3 The hirer will at all times comply with the operating instructions relating to the operation and handling of equipment.
    3.4 The hirer shall be responsible for ensuring that equipment is kept undercover at all times and is not exposed to rain, water, high humidity, direct sunlight, heat or any other damaging factor.
    3.5 The hirer agrees that the equipment will not be accepted as returned in good working order and/or condition, until it has been tested by Jazz Party Hire staff.

     

  4. CLEANING OF EQUIPMENT
    4.1 The hirer agrees that the electrical equipment such as the jukebox/karaoke machine, cocktail/slushie machine, lights and smoke machine etc are not to be dismantled or cleaned.
    4.2 The hirer agrees that the hired equipment is not to be dismantled (apart from the items that need to be removed for cleaning purposes).
    4.3 The hirer agrees to use non-abrasive cleaning goods to clean the hired equipment. DO NOTUSE STEEL WOOL ON ANY EQUIPMENT ESPECIALLY THE CHOCOLATE FOUNTAIN AS IT WILL SCRATCH IT AND A DAMAGE FEE WILL BE CHARGED. 
    4.4 Equipment that requires cleaning are items such as cocktail/slushie machine, chocolate fountain, popcorn machine, fairy floss machine and bain-marie. 
    4.5 All cocktail/slushie machines must be returned emptied of all liquids and flushed out with water. 
    4.6 The hirer agrees to return the hired products in the clean state in which they were hired out. Failure to do so will incur a cleaning fee of $50.00.

     

  5. CREDIT CARD DETAILS
    5.1 Jazz Party Hire will keep all personal information confidential, including credit card details.
    5.2 Jazz Party Hire requires each hirer to fill out a credit card form (VISA and MasterCard’s accepted). 
    5.3 Jazz Party Hire will not withdraw a deposit nor any other money from the credit card unless, as stated in Clause 5.4, money is owed, the equipment is not clean or damaged/broken (not working)/missing.  
    5.4 The hirer gives Jazz Party Hire permission to withdraw the appropriate dollar value owed by the hirer. Please refer to Clauses 2.4, 3.2, 4.4, 9.2 and 11.1 for more information.

     

  6. POWER CONNECTION AND POSITIONING
    6.1 The maximum extension cord length permitted is 10 meters measured from the first power point. 
    6.2 All equipment is to be plugged straight into a power point, not a plug board or double adaptor. Failure to do so may cause the equipment to break, which will make the hirer reliable to pay for replacement of broken equipment as stated in Clause 3.1. 3.2 and 3.3.
    6.3 All equipment is to be kept under a permanent shelter or marquee with side walls (for protection again the weather).  IT IS NOT TO BE KEPT UNDER A TARPAULIN OR IN THE OPEN AIR. 
    6.4 The jukebox/karaoke machine must be placed on a stable wooden platform or cement slab for protection against dirt or mud if used in a marquee. IT IS NOTTO BE PLACED ON DIRT, MUD OR GRASS AREAS.
    6.5 The cocktail/slushie machine will require a sturdy table due to the weight of the machine. A GLASS OR PLASTIC TOPPED TABLE IS NOT SUITABLE. 
    6.6 The chocolate fountain is to be kept inside a house. IT IS NOT SUITABLE FOR OUTDOOR USE.  
    6.7 All equipment needs to be positioned on an even ground, to avoid tipping over and equipment malfunctioning due to not being level. Refunds will NOT be given if equipment malfunctioned due to fault of the hirer. 

     

  7. STORAGE
    7.1 If the hirer is in possession of hired items overnight, the hirer will be responsible for storing all hired equipment in a lockable room.  The hired equipment shall be moved to and from the lockable room in accordance with the instructions provided.
    7.2 Failure to store the equipment in a lockable room may result in equipment being stolen or damaged/broken, which will result in the hirer needing to pay for replacement of the part or whole equipment as stated in Clause 3.1 and 3.2.

     

  8. FAILURE OR MALFUNCTION
    8.1 In the event of a failure or malfunction of equipment the hirer will immediately contact Jazz Party Hire. If there is no answer, the hirer is required to leave a voicemail in order for Jazz Party Hire to return the call with a solution ASAP. 
    8.2 In the event of there being a failure or malfunction of the equipment during the time it is in possession of the hirer which does not arise through misuse, mistreatment or some other breach of this agreement by the hirer, the hirer acknowledges that Jazz Party Hire will be responsible for a partial or complete refund of the hiring fees.
    8.3 Jazz Party Hire’s liability to the hirer in such circumstances shall be limited to a maximum of a complete refund of the hiring fee. (Refund depends on how much equipment could still be used). 
    8.4 The hirer agrees to indemnify Jazz Party Hire in relation to any claims by persons or entities who are not parties to the agreement arising out of the failure or malfunction of any equipment during the time of hire.

     

  9. USE OF HIRE ITEMS OTHER THAN AT PRIVATE RESIDENCE 
    9.1 The hirer agrees that the hired equipment will stay at the nominated address the entire time from delivery time to pick-up time. 
    9.2 Jazz Party Hire has the right to determine if the premises are secure for storing equipment at the premises overnight.  If the premises are not secure after inspection on delivery of equipment arrangements will be made to collect the equipment after the function and an after- hours fee may be charged.
    9.3 The hirer agrees that the equipment hired is for personal use only. Making money of the equipment is illegal and will be reported if caught.
    9.4 NOTE: IF EQUIPMENT IS HIRED FOR A FUNDRAISER, SCHOOL FAIR ETC CLAUSE 9.3 DOES NOT APPLY.

     

  10. USE OF PRODUCTS FOR EQUIPMENT
    10.1 The hirer agrees that the only products to be used in the equipment is the products supplied by Jazz Party Hire. For example, the chocolate for the chocolate fountain and the cocktail/slushie mixes provided. 
    10.2 The hirer agrees that there will be no refunds on unused products for the equipment by Jazz Party Hire. 
    10.3 Jazz Party Hire will not be held liable for any injury/allergic reaction arising out of the use or rental of the hired equipment. 
    10.4 THE HIRER IS RESPONSIBLE FOR READING ALL PACKAGING REGARDING ALLERGIES OR INTOLERANCES. For example, the chocolate supplied may contain traces of peanuts or other nuts. 
    10.5 The hirer may at their own discretion add alcohol to the supplied mixes (if desired) and does so at their own risk. 
    10.6 If requested, Jazz Party Hire will supply additional products (for example, more chocolate or extra cocktail/slushie mix). These are NON-REFUNDABLE even if unopened. 
    10.7 The hirer agrees to return all containers to Jazz Party Hire in order to receive their $5 refund. 

     

  11. LICENSING
    11.1 Jazz Party Hire holds relevant licenses to allow the use of all equipment at a private residence.
    11.2 Jazz Party Hire does not hold a liquor license and therefore does not supply any alcohol. 

     

  12. TRANSPORTATION OF GOODS
    12.1 Any goods collected from our premises are only to be transported within an enclosed vehicle, to be placed as advised by Jazz Party Hire and to be protected from damage whilst transported.  The hirer is responsible for the value of any repairs for damage whilst in transit.

     

  13. SIGNATURE
    13.1 Jazz Party Hire can refuse any hired equipment to leave the premises unless the hirer has signed the ‘Conditions of Rental Agreement for ALL Hire Equipment’ and ‘Operating Instructions’ forms.
